Register RC

We are currently collecting the contact information for residents that wish to be added to the respective Restrictive Covenant for their neighbourhood. If this is something you are interested in, please reach out to Guy Buchanan at (403) 589-6701 to add your name to the applicable list. Once we have a critical mass of new participants for your community and have confirmed participation through payment of the required fees, we will cause the required documentation to be prepared for your execution.

The information noted below from the original Kelvin Grove execution process provides insights about how the payment and execution of the process would likely proceed.

To initiate the registration of the Restrictive Covenant on your land title, please do the following:

Deliver a cheque on or before June 7, 2023, to your Area Coordinator or Block Captain for $500 made out to “Carbert Waite LLP, In Trust” and reference “Restrictive Covenant-Kelvin Grove” etc., depending on your neighbourhood.  

 

OR

For credit card payment, use the secure Carbert Waite LLP online payment system found  here: https://secure.lawpay.com/pages/carbertwaite/operating and, again, reference Restrictive Covenant-Kelvin Grove” etc., depending on your neighbourhood. Payment is due on or before June 7, 2023. Please alert your Block Captain if you are paying your fee electronically.

 

OR

For payment using interac E-Transfer, please send your E-Transfer to the email etransfer@carbertwaite.com and assign the password of CarbertWaite. Please also ensure your name, address and community name are placed in the comments section of the transfer. Please alert your Block Captain if you are paying your fee electronically.


If you have not already provided your Area Coordinator with your email address, please send them an email to let them know you have dropped off a cheque to them or have paid Carbert Waite online.

 

Carbert Waite LLP will prepare the registration documentation and legal waiver for your signature.

 

The waiver is basically an acknowledgement that:

 

  1. you have had the opportunity to seek independent legal advice about the form of the Restrictive Covenant;

  2. you have considered carefully your own circumstances when making the choice to enter into the Restrictive Covenant; and

  3. you accept that you have assumed certain risks, such as the possibility that a Court might at some point deem that the Restrictive Covenant is unenforceable, despite the care that was taken in creating the Restrictive Covenant.
